Oxnard Police Comment on Gang Injunction Changes

(Editor’s note: Armando Vazquesz regularly publishes here and has been doing a series on the Oxnard gang injunction, which he opposes. We asked OPD to comment on his last article, linked below.)

You asked “Is this accurate?” and there isn’t a simple answer to that question. We have spent most of 2018 working on a new injunction process and have met on three (3) separate occasions with Armando and CORE to gather input and ensure their voices were heard. We will be making a presentation at the December 18th City Council meeting in which we will recommend that all previously enjoined individuals receive notification that they are no longer bound by the prohibitions listed in the gang injunction(s). We will be seeking two amended gang injunctions and individuals served with the amended injunctions will have a judicial hearing prior to being subject to the terms listed in the injunction(s).
The statements in the editorial that “OPD acknowledged that they have overreached in this initial?roll-out of the original civil gang injunctions“, “OPD are now acknowledging and conceding that they were operating “prima facie” unconstitutional Civil Gang Injunction activities for the past 15 years against certain classes of people“, and “We will soon turn the page of the OPD’s 15 year dark reign of unconditional civil “gang” injunction law enforcement”?are hyperbole at best and factually untrue at worst.
We follow the law. When courts review matters and case law comes down which requires us to change our methods and/or procedures, we do so. It doesn’t mean we were doing something unconstitutional for “15 years”. We were doing what the courts said we should be doing.
